TERMS AND CONDITIONS OF USE

 

These Terms and Conditions of Use (“Terms”), along with our Privacy Policy (found here), govern your use of the Paradise Mountain Organic Coffee (“Paradise Mountain”) online and/or mobile services and online content provided on or in connection with www.paradisemountaincoffee.com (collectively, the “Services”).

Consent

By accessing or using the Services, you agree that you have read, understood, and agree with the Terms and Privacy Policy. As our business develops, we may make amendments to the Terms and Privacy Policy in order to protect our customers and meet our changing needs. We invite you to review the Terms and Privacy Policy from time-to-time in order to stay informed of these changes. Your continued use of the Services will be taken to be acceptance of these amendments.

 

Shopping Online with Paradise Mountain (Payment/Shipping/Returns)

Prices found on the Services may be in both Canadian and US dollars depending on your shipping location. All applicable taxes are added to the purchase based on the mailing information you provide at checkout.

 

Paradise Mountain’s online store accepts Visa, Master Card and PayPal as well as your billing address to ensure your coffee arrives at the right location! All credit card transactions will be processed through PayPal which is a very secure payment gateway that encrypts your card details in a secure host environment.

 

As coffee is a perishable product, we do not accept returns except in the case of damaged products or quality issues. If you do happen to receive damaged product please notify us right away with the details, along with your invoice number and a photo of the issue. We will replace your coffee purchase and make sure your morning Paradise is returned as soon as possible!

 

Paradise Mountain’s preferred carrier is Canada Post, with the option of using UPS for faster service within Canada. All US shipments will be delivered by FedEx Express.

Ownership and Restriction on Use

The content found on the Services is protected by national and international copyrights, trademarks, service marks, and other intellectual property and proprietary rights and laws and are owned by Paradise Mountain, our licensors, or their respective owners. All other products and/or trade names that are mentioned on the Services or are provided as part of the Services may be trademarks of their respective owners.

 

The use or misuse of any of these materials is strictly prohibited. Paradise mountain does not grant you a license with respect to the content of the Services or the intellectual property rights therein, except for the limited right to use the Services in accordance with these terms.

 

We may restrict your access to the Services, in whole or in part, for any reason, without notice to you or liability to us.

You may access, browse and use the Services only for your personal, non-commercial use, which includes emailing information from our site to someone else who you think would be interested in the content, provided you keep intact all copyright and other proprietary notices. ALTHOUGH WE WILL DO OUR BEST TO TRY TO ENSURE THE SERVICES ARE CURRENT AND DO NOT CONTAIN INACCURACIES, PARADISE MOUNTAIN DOES NOT WARRANT THE QUALITY, ACCURACY, CORRECTNESS, AVAILABILITY, COMPLETENESS, TIMELINESS, OR USEFULNESS OF ANY INFORMATION AVAILABLE ON THE SERVICES.

NONE OF PARADISE MOUNTAIN OR ANY OF ITS RESPECTIVE DIRECTORS, EMPLOYEES, AGENTS, OR OTHER REPRESENTATIVES SHALL BE LIABLE FOR ANY DAMAGES, CLAIMS, EXPENSES, INJURIES OR COSTS (INCLUDING WITHOUT LIMITATION LEGAL FEES) WHATSOEVER ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICES, WHETHER OR NOT SUCH DAMAGES MIGHT BE FORESEEABLE AND WHETHER OR NOT PARADISE MOUNTAIN HAS BEEN NEGLIGENT. THIS IS A COMPREHENSIVE LIMITATION OF LIABILITY THAT APPLIES TO ALL DAMAGES OF ANY KIND, INCLUDING (WITHOUT LIMITATION) COMPENSATORY, DIRECT, INDIRECT, EXEMPLARY, PUNITIVE AND CONSEQUENTIAL DAMAGES, AND CLAIMS OF THIRD PARTIES.

 

YOU ACKNOWLEDGE AND AGREE THAT YOUR USE OF THE SERVICES IS DONE AT YOUR OWN RISK AND THAT YOUR SOLE AND EXCLUSIVE REMEDY IS TO STOP USING THE SERVICES.

 

Indemnity

You agree to indemnify, defend and hold harmless Paradise Mountain, its owners, officers, directors, employees, agents, licensors, and suppliers from and against all losses, expenses, damages and costs, including reasonable legal fees, resulting from any violation of these Terms or the Privacy Policy or any activity (including negligent or wrongful conduct) related to your use of the Services.

 

Governing Law and Jurisdiction

By accessing the Services, you agree that all matters relating to the Terms or Privacy Policy and any dispute that may arise between you and Paradise Mountain will be governed exclusively by the laws and courts of the Province of British Columbia without regard to conflict of laws principles.

Entire Agreement

If any part of these Terms is determined to be invalid or unenforceable, including, without limitation, the warranty disclaimers and liability limitations stated herein, then the invalid or unenforceable provision(s) will be replaced by a valid, enforceable provision that most closely matches the intent of the original provision, and the remainder of these Terms shall continue in full effect.
